Section 50 of NDPS Act applies only to personal search, not to search of bag carried by person: Supreme Court
The Supreme Court recently held that Section 50 of the Narcotic Drugs and Psychotropic Substances Act, which outlines the procedure for searching a person, applies only to personal search and not to search of the bag carried by the person being searched.
The court said, “The interpretation of the law regarding the requirement to comply with Section 50 of the NDPS Act is no longer unified and this Court has held in clear terms that if the recovery is not from the person but from the bag being carried by him, then the procedure formalities prescribed under Section 50 of the NDPS Act need not be followed.”
