Conviction for dowry death under Section 304B cannot be sustained if dowry demand is not proved: Supreme Court
The Supreme Court has set aside the conviction for dowry death (under Section 304-B ​​of IPC). The court set aside the conviction observing that the prosecution failed to prove that the deceased wife had suffered cruelty or harassment by the husband immediately before her death in connection with the demand for dowry. The court set aside the conviction of the deceased's husband, sister-in-law and mother-in-law. The trial court had sentenced them to life imprisonment, which was also approved by the High Court.
