What is Protest Petition?
In simple terms:-
If the police say, “No case is made out” or “the accused is not guilty”, the complainant can file a protest petition to challenge that conclusion before a court.
Key points:-
●It is commonly used in criminal procedure (for example, under the system followed in countries like India).
●Filed before a magistrate after the police submit their report.
The complainant asks the court to:-
●Reject the police report, and/or
●Take cognizance (start legal proceedings) against the accused.
The court may:-
●Accept the protest petition and proceed with the case,
●Order further investigation, or
●Treat it like a private complaint and examine witnesses.
Example:-
If police close a fraud case saying there’s no evidence, the victim can file a protest petition arguing that evidence exists and requesting the court to continue the case.
