Hindu Marriage Act- Children born out of void marriage also have right over parent's property: Kerala High Court
The Kerala High Court recently granted terminal and pension benefits to three children born out of a man's void second marriage which he had entered into without dissolving the first marriage. Justice Harishankar V. Menon, relying on the Supreme Court's judgment in Revanasiddappa v Mallikarjuna (2023) and amending Section 16 of the Hindu Marriage Act, held that children born out of void marriage will also have right over parent's property.
